Definitions. In this Agreement, the word "e-Statement" refers to your periodic Statement Of Account. The word "e-Notice" refers to any notices you receive from First National Bank of Gilmer regarding your account(s). The word "e-Disclosure," refers to any other disclosures that we would normally provide to you in a written form that you retain. The words "you" and "your" refer to you, the customer of First National Bank of Gilmer. The words "we," "us," and "our," mean First National Bank of Gilmer.

Consent to Receive Periodic Statements and Disclosures Electronically. By clicking the "I Agree" button below, you agree to accept your e-Statements, e-Notices and e-Disclosures online. Your e-Statement includes transaction activity for all of your bank accounts, which includes savings, checking, certificates of deposits, loans, etc. You further agree that we may discontinue mailing a paper statement and/or notices to you if you requested us to stop sending them via the US Mail in accordance to your account agreement or service charge plan. You also agree that we may communicate with you electronically, as necessary. You also agree to receive other notices and/or disclosures online when we elect to make them available though our online banking system or in an electronic format. Notices would include, but are not limited to, CD Maturity or interest notices, NSF or OD Item notices, Loan Reminder notices, Overdraft notices, Safe Deposit notices, Charge Back notices, Past Due notices, Rate Change/Adjustment notices, Annual Privacy notices or transaction notices. The disclosures would include, but are not limited to, your periodic notice of billing error rights, your periodic notice of how to report errors that involve your electronic funds transfers and year-end tax statements for interest earned.

Requesting a Paper Copy of Disclosures. You may request a paper copy of your periodic statement, notice or any other record received electronically under this Agreement by writing to us at First National Bank of Gilmer, P.O. Box 520 – Gilmer, TX 75644; by e-mailing us at A fee may be charged for the paper copy. To avoid this fee, consider printing your e-Statement or e-Notices from your computer. The e-Statement, e-Disclosure and e-Notice browser page has a link available that will display a printable version of periodic statements, disclosures, terms, and important notices. (These disclosures may typically include your Regulation E, Privacy Rights, ATM Safety Precautions, Regulation D limitations, Customer Responsibilities, Debit Card transaction disputes, ID Theft victim claims, fee changes and other special terms to operate your accounts with the bank.)

Right to Withdraw Consent. You may terminate this Agreement at any time by notifying us in writing at the address or email address listed in the section above. There are no fees for requesting to withdraw your consent for e-Statements, e-Notices and E-Disclosures and going back to paper statements unless your checking service charge plan required the use of e-statements. In that case, your account may be changed to the account option which may include a monthly fee. Please contact our representatives if you need further information about service charge options. Please cancel prior to the last day of the month to receive a paper statement for that month's financial business.

System Requirements. The minimum requirements to view your account statements or notices
electronically are 64 MB of RAM, 500 MHz processor, Internet Explorer 6 or higher with 128 bit encryption, and a printer if you wish to print your e-Statement, e-Notices or e-Disclosures, or the ability to store (save) your e-Statement, e-Notices or e-Disclosures electronically to your computer. Adobe Reader version 10.0 or higher is required to view your e-Statement, e-Notices or e-Disclosures. A free download of Adobe Reader version 10.0 or higher is available at

E-mail Address and Notifications. Our system normally will send an email notification to your
account's email address on file to let you know an e-Statement or e-Notice was recently made available for viewing. Therefore, it is important that we keep a valid email address on file for your account. If you change your e-mail address, you agree to notify us of the new e-mail address you will be using. A returned email notification MAY cause us to stop sending you future notifications AND the automatic mailing of a paper statement or notice. If you had a signed up for receiving only e-Statements for your checking account and it was a condition for your account service charge, we may have to change your account to a service charge plan that does include mailed statements. You hereby approve the bank to make this change in service charge plans if necessary in the future.

Change of Internet Service Provider or Computer Equipment. If you change your computer
equipment or Internet Service Provider (ISP) used to access or receive electronic records, you agree to make any required security changes or authentication updates necessary to communicate security through our online banking system over the Internet. If we change the hardware or software to communicate electronically with you and our change materially affects your ability to access or receive communications electronically, we will notify you of the changes in writing or by e-mail and provide you with a statement of your right to withdraw consent. First National Bank of Gilmer does not accept requests for maintenance, installment, or technical support of your computer software or computer hardware.

Your Duties to Promptly Examine Statements & Notices. As part of your responsibilities as a
customer of the bank, we need you to promptly review your e-Statements and/or e-Notices after they have been made available to you. We will try to send an email to your last available address to let you know when a new e-Statement or e-Notice is created and available for your review. You will need to use our Online Banking service from our website, with a valid Login ID and password to view these documents.

Follow the steps below to view your e-Notices or e-Statements:
     • Click on
     • Logon to your Online Banking Account (required for this service)
     • Click Accounts List
     • Click the account you want to view
     • Click the document you want to view

We will assume you will exercise "reasonable promptness" in reviewing your e-Statements and e-Notices after we send or make them available. If you determine that an item contains an alteration, forgery, unauthorized signature, unauthorized transaction or any other posting error, you must notify us promptly. A "reasonable period" to report these types of challenges or errors will generally not exceed thirty (30) calendar days from the date we sent or should have made the statement available to you. If you fail to satisfy this requirement, (1) you cannot assert against the bank a claim for any of these disputed transactions, and (2) you cannot assert a claim against the bank for any item initiated by the same wrongdoer paid by us after the period of time mentioned above expires, but before you notify us. After sixty (60) calendar days, you cannot assert any claim against the bank, regardless to whether we exercised ordinary care and the loss for any forgery, alteration or unauthorized transaction will be entirely yours.

Electronic Transfers (Regulation E – for Consumer Accounts)

In case of errors or questions about your electronic transfers.

If you need more information about an electronic transfer appearing on an e-Statement; or if you think your statement or receipt is wrong; call or write us as soon as possible at the telephone number or addresses listed on the front of this statement. We must hear from you no later than 30 days from when the statement that contained the transaction was first made available to you.

  1. Tell us your name and account number

  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe there is an error or why you need more information.

  3. Tell us the dollar amount of the suspected error.

We will investigate your complaint and will correct any error promptly. If we take more than 10 business days to do this, we will re-credit your account for the amount you think is in error; so that you will have use of the money during the time it takes us to complete our investigation.

*For non-consumer accounts, refer to your account agreement to determine if there are different details regarding Electronic Funds Transfers.
